Terms of Service

1. Acceptance of Terms

By accessing or using picksoffice.com and any associated services including Discord and Telegram communities, you agree to be bound by these Terms of Service. If you do not agree, do not use the services. These Terms constitute a legally binding agreement between you and Picks Office.

2. Description of Service

Picks Office provides sports betting analysis, picks, and predictions based on quantitative models, a publicly tracked record of all picks with full transparency, educational content about sharp betting, bankroll management, and expected value, access to Discord and Telegram communities for subscribers, and tools including calculators for EV, Kelly criterion, hedging, and odds conversion.

Picks Office is an information and entertainment service. It does not constitute financial advice, investment advice, or gambling advice. Picks Office does not facilitate gambling or accept bets. All betting decisions are made at your own discretion and risk.

3. Eligibility and Registration

To use the services, you must be at least 18 years old or the legal gambling age in your jurisdiction, whichever is higher. You must provide accurate and complete registration information, keep your login credentials secure and not share your account, be located in a jurisdiction where accessing sports betting analysis is legal, and comply with all applicable local, state, national, and international laws. You are solely responsible for ensuring compliance with the laws of your jurisdiction.

4. Subscriptions, Payments and Refunds

Pro features require a paid subscription processed through Stripe. Subscriptions renew automatically at the end of each billing period. By subscribing, you authorize recurring charges to your payment method at the then-current rate.

You can cancel at any time from your dashboard or by emailing support@picksoffice.com. Cancellation takes effect at the end of the current billing period and you retain access until then. There is no cancellation fee.

All sales are final. No refunds will be issued for any subscription period, whether partially or fully used. By subscribing, you acknowledge and accept this no-refund policy.

Prices may change with at least 30 days advance notice to existing subscribers. You may cancel before the new rate takes effect.

5. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform me (Picks Office, Luca Eggerdinger, Pfarrkirchener Str. 10, 84389 Postmünster, Germany, email: support@picksoffice.com) of your decision by an unequivocal statement (e.g., a letter sent by post or email).

Important: Your right of withdrawal expires prematurely once I have begun delivering the digital content, provided that you have expressly agreed that delivery begins immediately and acknowledged that you thereby lose your right of withdrawal (§ 356(5) BGB).

The right of withdrawal applies to EU consumers only. US customers are not entitled to a right of withdrawal under these Terms.

6. Prohibited Conduct

You agree not to redistribute, resell, screenshot for redistribution, copy, or share pro content with non-subscribers. You may not use automated tools, bots, or scrapers to extract data from the site. You may not attempt to gain unauthorized access to restricted areas or other users' accounts. You may not use the service for any unlawful purpose, misrepresent Picks Office picks, analysis, or models as your own work, engage in hate speech, harassment, or abusive behavior in communities, or engage in fraudulent activity including using stolen payment methods.

Violation may result in immediate account termination without refund. I reserve the right to pursue legal action for intellectual property theft or fraud.

7. Intellectual Property and DMCA

All content on picksoffice.com including analysis, models, picks, graphics, code, and educational material is the intellectual property of Picks Office. Your subscription grants you a personal, non-transferable, non-exclusive license to view and use the content solely for your own betting decisions. You may not reproduce, distribute, or create derivative works without written permission.

If you believe copyrighted work has been infringed, or discover unauthorized redistribution of Picks Office content, send a written notice to support@picksoffice.com with identification of the copyrighted work, identification of the infringing material, your contact information, and a good-faith statement that the use is unauthorized.

8. Affiliate Disclosure

Picks Office participates in affiliate partnerships with select sportsbooks. When I recommend or link to a sportsbook, I may earn a commission if you sign up through that link. Current partners include Bet105 and Bracco on a revenue-share model. Affiliate relationships never influence my picks, analysis, or recommendations. Affiliate links are always clearly identified with an "Ad | Affiliate" label. This disclosure is made in compliance with the FTC's Endorsement Guides (16 CFR Part 255).

Bet105 may not be licensed in your jurisdiction. It is your responsibility to check and comply with local laws before using any sportsbook. You must be 18+ (21+ in some US states). Bracco operates under sweepstakes law and is not a traditional sportsbook.

9. Disclaimer

Sports betting involves significant financial risk. You can lose money, sometimes a lot of money. Only bet with funds you can afford to lose entirely. Past performance does not guarantee future results.

The services are provided "as is" and "as available" without warranties of any kind. There is no warranty that picks will be profitable, that the service will be uninterrupted, or that any content is accurate, complete, or timely.

Any references to ROI, win rates, or historical performance (e.g., "+7.4% ROI") reflect past results only. Past performance is not indicative of future results. Individual results may vary.

10. Restricted Jurisdictions

Sports betting is restricted or prohibited in certain US states, including but not limited to Utah, Hawaii, and Idaho. Users in jurisdictions where sports betting or accessing sports betting analysis is restricted or prohibited should not use my affiliate links or place bets based on my content. It is solely your responsibility to verify the legality of sports betting in your jurisdiction.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Picks Office accepts no liability whatsoever for any direct, indirect, incidental, consequential, or special damages arising from your use of or reliance on any content, any financial losses from sports betting, errors or omissions in any content, or service interruptions. Total liability under these Terms shall not exceed the amount you paid in the preceding 12 months.

12. Account Termination

I reserve the right to suspend or terminate your account if you violate these Terms of Service, redistribute or share subscriber-only content, engage in hate speech or abusive behavior in communities, use fraudulent payment methods or engage in chargebacks, or engage in any form of fraud or deception. Terminated accounts lose access immediately. No refund is issued upon termination for cause.

13. Modifications to Terms

I reserve the right to modify these Terms at any time. Significant changes will be communicated via email at least 14 days before taking effect. Your continued use after changes become effective constitutes acceptance. If you disagree, cancel your subscription before they take effect.

14. Governing Law and Jurisdiction

For EU residents: These Terms shall be governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the competent courts at the seat of the business in Postmünster, Bavaria, Germany. Mandatory consumer protection provisions of your country of residence remain unaffected. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For US residents: These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Dispute Resolution (US Users)

Binding Arbitration. For users located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the use of the services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between you and Picks Office individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Opt-Out. You may opt out of this arbitration provision by sending written notice to support@picksoffice.com within 30 days of first accepting these Terms.

Exception. This arbitration provision does not apply to EU consumers, who retain their rights under applicable EU consumer protection law.

16. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be modified to the minimum extent necessary or severed. All remaining provisions continue in full force.
